Agreeing to these terms
These terms cover your use of the K&R Somerville Concrete Construction website and any work you hire us to do. By using the site, asking for a quote or booking a job, you agree to them.
If you don't agree, please don't use the site or book work with us. Questions are welcome before you decide, and our contact page has every way to reach us.
What we do
We're a concrete contractor in Somerville, MA, and we pour and repair driveways, patios, walkways, steps, slabs, foundations, footings and other concrete work for homes and businesses in Somerville and the cities around it. The home page lists our services, and you can read more about our crew.
Descriptions on this site are general. Your job is defined by the written estimate or contract we give you, and that document wins if it says something different from a page on this site.
Estimates and pricing
We give free quotes on site, with no pressure to book. A quote is based on what we can see and measure on the day, so it covers the scope, materials and price written on it, and it stays open for the period stated there.
Some conditions only show up once the old concrete is out, such as soft or wet ground under the slab, buried roots, old footings or utility lines. If we find something like that, we'll stop, show you, and agree any change in price or scope with you in writing before we go on.
Prices on the site, if any appear, are general information and not an offer. The only price that binds either of us is the one in your signed estimate or contract.
Scheduling, weather and cancellation
We schedule your pour for the date we agree on, but concrete depends on the weather, so heavy rain, freezing temperatures or extreme heat can push the date back. We'd rather move a pour than put down a slab that won't last, and we'll tell you as soon as we know a date has to change.
Delays caused by weather, material shortages, permit timing or other things outside our control don't count as a breach of our agreement.
If you need to cancel or reschedule, call us at (617) 284-0921 as early as you can. Once we've ordered materials, set forms or started work, you may owe us for costs already incurred, as your contract describes.
Your part of the job
You agree to give our crew access to the work area, to tell us about anything you know is buried there, and to keep people, pets and vehicles off fresh concrete until we say it's ready. New concrete needs time to cure, which is the wait while it hardens to full strength, and damage from early use isn't covered by our workmanship promise.
Permit requirements vary by city and by job. Unless your contract says we'll handle it, checking whether your project needs a permit, and getting it, is your responsibility.
Payment
Your estimate or contract sets out any deposit, when payments are due and which payment methods we accept. The balance is due when the work is finished as described, unless your contract says otherwise.
If a payment is late, we may pause work until it's made, and we may recover reasonable collection costs where Massachusetts law allows.
Our workmanship promise and its limits
We're fully licensed and insured, and we stand behind our work with satisfaction guaranteed on every job. If something isn't right, tell us and we'll come back and look at it.
Concrete is a natural material, and small hairline cracks, slight color differences and surface variation are normal and aren't defects. We cut control joints, which are planned grooves that give the slab a place to crack in a straight line, to keep cracking where it does the least harm, but no contractor can promise a slab will never crack.
Our promise doesn't cover damage from de-icing salts, heavy vehicles beyond what the slab was built for, ground movement, frost heave, tree roots, poor drainage from areas we didn't work on, or work changed or repaired by someone else. Apart from what's written in your contract, and to the extent the law allows, we make no other warranties, express or implied.
Limits on our liability
To the extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect or follow-on losses, such as lost use of a driveway while it cures or lost business.
This website is provided as is. We try to keep it accurate, but we don't promise it's free of errors or always available, and we aren't responsible for outside sites we link to.
Settling disagreements
If you're unhappy with anything, call us first, because most problems get sorted out quickly when we talk them through on site. If we can't agree, we'll both try in good faith to settle it through mediation before either of us goes to court.
Any court case will be brought in the courts serving Middlesex County, Massachusetts, unless the law requires a different place.
Governing law
These terms and any work we do are governed by the laws of the Commonwealth of Massachusetts. Nothing here takes away any right you have under Massachusetts consumer protection law.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one that applies. A change won't affect a contract you've already signed unless we both agree to it in writing.
